A new judge is presiding over the trial of Tim McGraw in Orchard Park, N.Y. Town Justice John Curran announced Monday (May 21) that he is taking over the case. Curran also said the jury will give him an advisory verdict in the related case against Kenny Chesney, whose verdict originally was to be determined by the judge. The trial was interrupted Thursday (May 17) when Justice Edmund S. Brown suffered a heart attack. In another development, The Associated Press reported Monday that Sergeant Mark Rokitka has filed a lawsuit against McGraw and Chesney. He seeks an undetermined amount of money, claiming his scuffle with the country stars caused pain and suffering, loss of time on the job, mental anguish, emotional distress and loss of enjoyment of life.

 - I think he's a wacko. He shouldn't have joined the force if he can't handle this! It seems he's just going for easy cash.

I agree. This is ridiculous. Would he be suing any old guy off the street for this same incident?

Even if he had suffered substantial physical injury, it's part of the job description and his compensation is his salary.
